2.4 Where to Send DMCA Notices

3. Response to DMCA Notices
3.1 Processing Timeline
Upon receipt of a valid DMCA notice, we will:
- Within 24-48 hours: Acknowledge receipt of your notice
- Within 3-5 business days: Review the notice for completeness and validity
- Upon validation: Remove or disable access to the allegedly infringing material
- Notification: Inform the user who posted the content of the removal
3.2 Actions Taken
If we determine the DMCA notice is valid, we will:
- Remove or disable access to the infringing material
- Notify the user who uploaded the material
- Provide the user with a copy of the DMCA notice
- Inform the user of their right to file a counter-notice
- Track repeat infringers and may terminate their accounts
4. Counter-Notification Procedure
4.1 Filing a Counter-Notice
If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification.
Important: Filing a false counter-notice may result in legal consequences. Ensure you have a legitimate basis before proceeding.
4.2 Required Information for Counter-Notice
Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed or disabled and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located
- A statement that you will accept service of process from the person who filed the original DMCA notice
4.3 Counter-Notice Template

4.4 Counter-Notice Processing

5. Repeat Infringer Policy
5.1 Three-Strike Policy
3DMecWorks maintains a repeat infringer policy in accordance with the DMCA:
- First Violation: Warning issued, content removed
- Second Violation: Temporary account suspension (30 days), content removed
- Third Violation: Permanent account termination, all content removed
5.2 Account Termination
We reserve the right to terminate accounts of users who:
- Repeatedly infringe copyrights
- Upload content they know is copyrighted without authorization
- File false DMCA notices in bad faith
6. False Claims and Misrepresentation
Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents:
- That material is infringing, or
- That material was removed or disabled by mistake
...may be subject to liability for damages, including costs and attorneys' fees.
7. Limitations and Exceptions
7.1 Fair Use
We recognize that certain uses of copyrighted material may qualify as fair use under copyright law. Before filing a DMCA notice, please consider whether the use might be protected as fair use.
7.2 Public Domain and Licensed Content
Content in the public domain or used under appropriate licenses (Creative Commons, GPL, etc.) is not subject to DMCA takedown.

8.1 Before Uploading Content
Users must ensure they have the right to upload content by:
- Creating original work themselves
- Obtaining proper licenses or permissions
